The following terms and conditions may be amended from time to time and apply to all of our tour services. By reserving one of our tours, you agree that you have read, understood, and consent to be bound by all of the terms and conditions, including any terms and conditions that may change, regardless of when you reserved your tour.
1. Booking
All tour reservations are confirmed in the order that full payment is received and that confirmation of your tour participation is sent. A waiting list may be available for prospective participants who send in full payment. You have an affirmative obligation to disclose to us if you have any mental, physical, or medical condition that could impair your ability to participate fully on this tour. We reserve the right to deny participation to any prospective or confirmed tour participant for any reason, with final discretion to determine any partial to full refund offered in such hopefully rare circumstances. We also reserve the right to require travel insurance and may cancel your participation if you fail to provide proof of a paid policy and maintain that policy throughout the tour. You also agree to sign a waiver of all claims and to release Noona’s Noonchi and its entities and officers from all liability.
2. Cancellation
All tour reservations are fully refundable for up to 7 days. After 7 days and up to 30 days before the start of your tour, you may receive a 50% refund. Within 30 days of your tour, all payments are non-refundable. If a tour must be canceled for unforeseeable or exigent circumstances, we will refund and are only liable for your full purchase price. No refund is available for non-participation in any aspect of the tour.
3. Travel Insurance
We require that you purchase a travel insurance policy in your country of residence that will cover you for any tour-related and travel-related risks, including accident, health, property, and other issues. We are not responsible for any accident, loss, damage, sickness, injury, inconvenience, alleged crime, act of God, or other adverse issue or circumstance related to this tour. You agree to fully indemnify and hold harmless Noona’s Noonchi LLC, Noona’s Noonchi, Inc., and its associated entities, officers, or agents from all liability, against any injury, damage, or accident, both as an individual and by naming Noona’s Noonchi LLC (a U.S. company) and Noona’s Noonchi, Inc. (a Korean company) with any insurance coverage that you have.
4. Pricing
We have made our best effort to create pricing that is reasonable and competitive, and for these first few tours, our pricing is largely indicative of our costs. All charges and refunds are made in USD. We do not charge any booking fees, and we are not responsible for any of your payment method’s transaction fees, currency exchange fluctuations, foreign transaction fees, or other third-party fees. Prices are subject to change until full payment is received for the tour and until you receive a confirmation of your tour participation.
5. Itinerary
We have made our best effort to create a thoughtful, high-quality tour experience for each and every tour participant. Our published itinerary reflects our intended activities, but we reserve the right to alter any itinerary for any reason and are not responsible for other conditions that may affect the itinerary but may be out of our reasonable control.
6. Participation
We will make our best effort to allow every member of our group to participate in activities on this tour. Each and every participant undertakes all activities at their own risk, and you must take reasonable care and responsibility to determine your level of participation in tour activities. We reserve the right to refuse participation to any participant who we believe will not be able to engage in certain activities due to our perceptions of their conditions, limitations, or behaviors. We will try to inform you with guidance on appropriate clothing, gear, or other preparation needed to participate. Should we or you decide that you may not participate in certain tour activities, no refund is available
to you. We also reserve the right to refuse participation to participants who we believe are under the influence of alcohol or drugs, or to remove participants in cases where other participants may be offended or placed into risk.
7. Promotional Release
These tours are conducted with many participants in public places, so you may be included, either purposefully or incidentally, in photographs, videos, or even mentioned or tagged in social media posts. All tour participants must agree to grant Noona’s Noonchi, its agents, and other tour participants a worldwide, royalty-free, irrevocable license to use your image or likeness. If you do not wish to participate in any such content, please let us know, and we can attempt to accommodate you, but we cannot guarantee and are not liable for not doing so. We hope that you understand this is intended to be a fun, relaxed, and often team-building trip, and we hope that we and all participants will be respectful and accommodating to one another.
8. Transit
We will make our best effort to provide most transportation for you after the start of the tour until the end of the tour, for all official tour activities. You are responsible for your own transit to our initial meetup location, and you are also responsible for your own transit after our final meetup location. During the tour, we will provide a bus and other transit to all official tour activities. You are responsible for ensuring that you are present at all official tour activities for which you would like to participate, and should you be late or not participate for any reason, you will be responsible for transiting at your own expense and risk.
9. Lodging
We will make our best effort to provide the best lodging that we can for you within the budget that we have available. You are responsible for all lodging before the start of the tour and after the end of the tour. During the tour, we will provide lodging equivalent to three, four, or five star accommodations, when and where reasonably available.
10. Food and Drinks
We will make our best effort to develop a quality, memorable food experience for you. You have an affirmative obligation to notify us of any dietary restrictions or allergies that you have, and we will attempt to accommodate you. You should be prepared to be responsible for special or additional food that you may want that we decide not to accommodate. All drinks are considered additional charges not within the tour budget, so you are responsible for having additional cash-on-hand for any beverage requests.
11. Personal Property
We are not responsible for any of your personal belongings or luggage related to this tour. We ask you to be careful about bringing significant cash or valuables, to be aware of your surroundings, and to pack as lightly as possible. In some cases, we may limit the luggage that we may transit on our buses.
12. Mediation and Arbitration
Noona’s Noonchi tours are owned and overseen by Noona’s Noonchi, Inc., a Korean company, and not by Noona’s Noonchi LLC, a US company. The only Noona’s Noonchi entity associated with these tours is Noona’s Noonchi, Inc., and you agree that any issues related to the tour that involves Noona’s Noonchi may only be addressed and claimed through the Korean company, which manages the relationships with our tour vendors. We partner with professional tourism and hospitality companies, so you agree that any issues that you may have related to transit, lodging, food and drink, and other tour activities must be addressed directly with those providers, as you agree we are not liable. Any concerns with tour participants must be addressed directly with that participant, as you agree we are not liable. Any issues concerning the conduct of Noona’s Noonchi LLC, its associated or perceived to be associated entities, its officers, and its agents must first be considered through mediation by a mediator agreed to by the parties at issue, and subsequently through final and binding arbitration, with a location, time, process, and selection of arbitrator(s) determined by Noona’s Noonchi, Inc. All tour participants explicitly agree to waive their rights to petition to and be adjudicated by the courts, and the costs of mediation, arbitration, and related proceedings must be borne equally by all parties at issue, regardless of prevailing party. In the case of disputes related to the interpretation of this agreement, the governing law and jurisdiction will be exclusively under the laws of South Korea, unless another law and jurisdiction is agreed to by the parties.
